Terms of Service — See Myself Well

Please read these Terms of Service carefully before using See Myself Well. By creating an account or using the app, you agree to be bound by these terms. If you do not agree, do not use See Myself Well.

1. Who We Are

See Myself Well is operated by Jessica Irwin, an individual doing business as See Myself Well, based in the United States. References to “we,” “us,” or “our” refer to See Myself Well. References to “you” or “your” refer to the person using the app.

2. What See Myself Well Is

See Myself Well is a personal health intelligence platform that helps you track health data from wearable devices and manual entries, set personal wellness goals, and receive AI-generated insights about patterns in your data. The app is designed to help you understand your own health data and identify lifestyle factors that may influence your personal goals.

See Myself Well is a wellness tool, not a medical device. It is not intended to diagnose, treat, cure, or prevent any medical condition. The insights generated by the app are based on your personal data and general wellness patterns. They are not medical advice and should not be treated as such. Always consult a qualified healthcare provider before making changes to your diet, exercise, medication, or other health-related behaviors.

3. Eligibility

To use See Myself Well, you must:

Be at least 18 years of age
Be capable of entering into a binding agreement
Not be prohibited from using the app under applicable law
Provide accurate and complete registration information

See Myself Well is not intended for use by minors. If you are under 18, do not create an account or use the app.

4. Your Account

When you create an account, you are responsible for:

Keeping your password secure and confidential
All activity that occurs under your account
Notifying us promptly at irwin.jessica1975@gmail.com if you suspect unauthorized access

You may not share your account with others, create multiple accounts, or use another person's account without their permission. We reserve the right to suspend or terminate accounts that violate these terms.

5. Subscriptions and Billing

Free tier

See Myself Well offers a free tier with limited features including manual health event logging, basic goal tracking, and limited AI insight generation. The free tier does not require payment information.

Premium subscription

Premium features including voice journaling with AI extraction, wearable device sync, unlimited goals, and on-demand AI insights require a paid subscription. Premium is available at the following rates:

Monthly: $12.99 per month
Annual: $99.99 per year (equivalent to approximately $8.33 per month)

Free trial

New accounts receive a 14-day free trial of the Premium subscription. No payment information is required to start a trial. At the end of the trial period, you will be asked to provide payment information to continue Premium access. If you do not subscribe, your account will revert to the free tier and no charge will be made.

Billing and renewal

Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date. You authorize us to charge your payment method on file for each renewal. Payments are processed by Stripe. We do not store your payment card information.

Cancellation

You may cancel your subscription at any time from the Settings page of the app. Cancellation takes effect at the end of your current billing period. You will retain Premium access until that date. We do not provide refunds for partial billing periods except where required by applicable law.

Price changes

We may change subscription prices with at least 30 days' notice by email and in-app notification. Price changes take effect at your next renewal date. Continued use after a price change takes effect constitutes acceptance of the new price.

6. Acceptable Use

You agree to use See Myself Well only for lawful purposes and in accordance with these terms. You agree not to:

Use the app in any way that violates applicable law or regulation
Attempt to gain unauthorized access to any part of the app or its infrastructure
Reverse engineer, decompile, or disassemble any part of the app
Use automated tools to scrape, crawl, or extract data from the app
Submit false, misleading, or inaccurate health data with the intent to manipulate AI outputs
Use the app to harm, harass, or deceive other users
Impersonate any person or entity
Attempt to interfere with the proper functioning of the app

We reserve the right to suspend or terminate access for any user who violates these terms, with or without notice.

7. Your Health Data

You own your health data. We collect and process it only to provide you with the service you have signed up for, as described in our Privacy Policy.

By using See Myself Well, you grant us a limited license to process your health data for the sole purpose of operating the app and generating insights on your behalf. We do not sell your health data, use it for advertising, or share it with third parties except as described in our Privacy Policy.

You are responsible for the accuracy of the data you enter. AI-generated insights are based entirely on the data you provide. Inaccurate or incomplete data will result in less accurate insights.

8. AI-Generated Insights

See Myself Well uses artificial intelligence to identify patterns in your health data and generate personalized insights and recommendations. By using the app, you acknowledge and agree that:

AI insights are generated based on your personal data and general wellness research, not medical knowledge about your specific health situation
AI insights are informational only and do not constitute medical advice, diagnosis, or treatment recommendations
AI systems can make errors, and insights may not be accurate for every individual
You should not make significant health decisions based solely on AI-generated insights without consulting a qualified healthcare provider
The AI insight engine improves over time as you log more data, and early insights carry lower confidence than insights generated after 30 or more days of consistent logging

9. Third-Party Integrations

See Myself Well connects to third-party services including Oura Ring, Keto-Mojo via MyMojoHealth, and Apple Health. Your use of those integrations is subject to the terms and privacy policies of those respective services. We are not responsible for the data practices, availability, or accuracy of third-party services.

Connecting a third-party service is entirely optional. Disconnecting a service from within See Myself Well removes our ability to sync new data from that service. It does not affect data that has already been synced or data stored within the third-party service's own platform.

10. Intellectual Property

See Myself Well and its original content, features, design, and functionality are owned by Jessica Irwin and are protected by applicable intellectual property law. You may not copy, modify, distribute, sell, or lease any part of the app or its content without our prior written permission.

Your health data and journal entries remain your property. We claim no intellectual property rights over the content you create within the app.

11. Disclaimers

See Myself Well is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. We do not warrant that:

The app will be uninterrupted, error-free, or completely secure
The results obtained from using the app will be accurate or reliable
Any defects in the app will be corrected
The app or the servers that make it available are free of viruses or other harmful components

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nothing in the app should be construed as the practice of medicine, nursing, or any other licensed health care profession. Always seek the advice of a physician or other qualified health provider with any questions you may have regarding a medical condition.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Jessica Irwin and See Myself Well shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or health-related outcomes, arising from your use of or inability to use the app, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising from these terms or your use of the app shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Jessica Irwin and See Myself Well from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising from your use of the app, your violation of these terms, or your violation of any rights of a third party.

14. Termination

We may suspend or terminate your access to See Myself Well at any time, with or without cause, with or without notice. Reasons for termination may include violation of these terms, non-payment, or legal requirements.

You may terminate your account at any time from the Settings page. Upon termination, your right to use the app ceases immediately. Your health data will be deleted within 30 days as described in our Privacy Policy.

Sections of these terms that by their nature should survive termination will survive, including sections on intellectual property, disclaimers, limitation of liability, and indemnification.

15. Governing Law and Disputes

These terms are governed by the laws of the United States and the state in which Jessica Irwin is domiciled, without regard to conflict of law principles.

Any dispute arising from these terms or your use of See Myself Well will first be addressed through good-faith negotiation. If we cannot resolve a dispute informally, both parties agree to submit to binding arbitration under the rules of the American Arbitration Association, conducted in English. You waive any right to a jury trial or to participate in a class action lawsuit.

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm.

16. Changes to These Terms

We may update these Terms of Service from time to time. When we make material changes, we will notify you by email and in-app notice at least 14 days before the changes take effect. Your continued use of See Myself Well after the effective date of the revised terms constitutes your acceptance of them.

If you do not agree to the revised terms, you may cancel your subscription and delete your account before the effective date.

17. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and See Myself Well regarding your use of the app. They supersede any prior agreements or understandings.

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
